MSPB Attorneys and Their Functions

In the federal government, there are people who operate independently and quasi-judicially in order to protect and preserve the federal merit systems. Attorneys who belong to the U.S Merit Systems Protection Board (MPSB) all have the same responsibility and classification.

This special group of attorney’s is responsible for adjudicating federal employee appeals and any other concerns. Examples of such are complaints filed under the Whistleblower Protection Act, the Uniformed Services Employment and Reemployment Rights Act, and the Veterans’ Employment Opportunities Act. As for discrimination cases, this is normally not in the MSPB attorney’s regularly handled cases but in cases like an adverse employment action otherwise, which is within the jurisdiction of the MSPB, an example of such is removal from the job, and alleged to have been based on prohibited discrimination, the Board can then hear the entire claim. This is often times described as a mixed case. Neither does the mspb attorney give any legal counsel or advice on examinations, employment and any kind of benefits.
